Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of the Servtio platform, operated by Miguel Simões, a sole proprietor (hereinafter referred to as “Servtio”). By using the platform, the user declares that they have read, understood, and fully accept these Terms. If you do not agree with any provision, you should not use the platform.
1. Definitions
For the purposes of these Terms, the following definitions apply:
- Servtio / Platform — the website and other digital channels operated by Servtio, which allow the publication of service requests and their viewing by providers.
- User — any person who accesses the platform, with or without a registered account.
- Client — a user who creates service requests on the platform.
- Provider — a user who registers as a professional or company to view requests, submit proposals, and provide services to Clients.
- Account — an individual registration created by a user, associated with an email address and/or other identifiers.
- Provider Profile — a page associated with a Provider, which may include name, photograph, description, geographic area, categories/professions, experience, contact details and, when available, Client reviews.
- Request — a service request created by a Client through the platform.
- Subscription / Plan — a paid model that allows the Provider to access a certain number of requests, in accordance with the commercial terms in force.
- Ratings and Reviews — star ratings and written feedback provided by Clients about their experience with Providers, when such functionality is available.
2. Account Creation and Use of the Platform
The platform is intended for users aged 18 or over with legal capacity to contract. By creating an account, the user declares that they meet this requirement.
- The user must provide true, complete and up-to-date information.
- They are responsible for maintaining the confidentiality of their login credentials.
- It is forbidden to use the platform for fraudulent, unlawful, abusive, spam-related purposes or in ways that violate the rights of third parties.

Servtio reserves the right to suspend or terminate accounts that:
- violate these Terms or applicable law;
- use false, outdated, or third-party data without authorization;
- attempt to circumvent usage limits, subscriptions, or security mechanisms;
- use the platform in an abusive, offensive, or harmful manner toward others or Servtio.
3. Intermediation Nature
Servtio is an intermediation platform that connects Clients and Service Providers. Servtio:
- does not participate in negotiations or service execution;
- does not define or guarantee prices, deadlines, or commercial conditions;
- does not guarantee results, quality, or suitability of the service to Client expectations;
- is not a party to the contract entered into between Client and Provider.
Any contract, agreement, payment, or professional relationship established between Client and Provider is the sole responsibility of those parties.
4. Content, Requests and Profiles
Information published by users (including request descriptions, Provider profiles, messages and other content) is the sole responsibility of the person who publishes it.
Users agree not to publish content that is:
- false, misleading, outdated or incomplete;
- defamatory, offensive, threatening, discriminatory or obscene;
- in violation of copyright, trademarks, or other intellectual property rights;
- containing viruses, malicious code or elements that may affect platform operation.
Servtio may, but is not obliged to, moderate, edit or remove content that it considers to violate these Terms or the law, as well as suspend, limit or close accounts associated with such content.
Providers are responsible for keeping their profile true and up-to-date, including information about services offered, areas of operation and, where applicable, contact details.
5. Ratings and Reviews
The platform may allow Clients to leave ratings and reviews about Providers after a service is rendered.
- Ratings and reviews must be based on real experiences, be honest, and written respectfully.
- Any attempt to manipulate the review system is prohibited, including creating fake accounts or asking third parties to review without having used the service.
- Providers may not review themselves, directly or indirectly.
Servtio may, but is not obliged to, verify the authenticity of reviews or moderate/remove content that violates these Terms or applicable law. Reviews and comments reflect the opinion of users and do not constitute statements or guarantees by Servtio regarding the quality or competence of Providers.
6. Subscriptions, Plans and Access to Requests
Use of the platform is free for Clients, who may submit requests at no cost. Access by Service Providers to published requests depends on the purchase of a subscription plan.
The description of available plans, included request limits, prices, billing frequency and other commercial conditions is always kept up to date on the page Available Plans
- Subscriptions may include automatic renewal unless stated otherwise.
- Cancellation prevents future renewals and does not grant a refund of amounts already paid, except where required by law or by a specific platform policy.
- Access to requests does not guarantee jobs, hiring, or any economic return for the Provider.
Servtio acts solely as an intermediation platform and assumes no obligation to generate requests, contacts, business opportunities or jobs for Providers, and cannot be held responsible for the absence or insufficiency of requests on the platform, including within specific professions, categories, or time periods.
Visibility, Contacts, and Follow-Up Rules
- Each Request created by a Client may be presented to eligible Service Providers, according to profession, category, subscription plan, and other applicable criteria.
- The Client’s contact details (email and mobile phone number) become accessible to the Service Provider when they click “View details”.
- For subscription purposes, each “View details” action corresponds to 1 request, which is deducted from the monthly or annual limit of the Service Provider’s plan.
- A Request may have its contact details viewed by, at most, 5 Service Providers. Once this limit is reached, the Request is no longer presented to new Service Providers.
- The platform may send automatic follow-up communications to the Client to confirm whether the Request has been resolved or to allow it to be recreated.
- If the Client takes no action within the deadlines defined by the platform, the Request may be marked as expired and moved to history.
Note: for technical, operational, security, or abuse-prevention reasons, the criteria for presenting, counting, and availability of requests may be adjusted, while maintaining the objective of protecting Clients and Service Providers and ensuring the balanced operation of the platform.
7. Limitation of Liability
To the maximum extent permitted by law, Servtio shall not be liable for:
- direct or indirect damages, loss of profits, data loss or other losses resulting from the use (or inability to use) the platform;
- acts, omissions, errors, delays or contractual/non-contractual breaches committed by Clients or Providers;
- any conflict, dispute or damage arising from the relationship between Client and Provider;
- temporary unavailability of the platform resulting from server failures, hosting provider issues, communication networks, scheduled maintenance, technical updates, security incidents or other external factors reasonably beyond Servtio’s control.
If any liability is nevertheless determined on the part of Servtio, it shall be limited, to the maximum extent permitted by law, to the amount paid by the user to Servtio for the active subscription plan during the billing period in which the event giving rise to the claim occurred, and no compensation shall be due for previous or future billing periods.
8. Account Suspension and Termination
Servtio may, at any time and without obligation to compensate, suspend or terminate a user’s access to the platform where:
- a violation of these Terms or applicable law exists;
- fraudulent, abusive or harmful behavior is detected;
- there is misuse of subscriptions or attempts to bypass limits or security;
- the account is continuously used in a manner inconsistent with the platform’s operating model and purpose.
In cases of account termination due to serious breach of these Terms, amounts already paid will not be refunded, unless otherwise required by law.
9. Platform Suspension or Shutdown
Servtio may, for technical, legal, business, economic viability, or other justified reasons, temporarily suspend or permanently shut down the platform, in whole or in part.
Whenever reasonably possible, prior notice will be given to users through the platform and/or by email. The shutdown of the platform does not in itself give rise to compensation, without prejudice to any specific legal obligations that may apply.
10. Intellectual Property
All proprietary content on the platform (including logo, design, layout, institutional texts, code and graphic elements) is owned by Servtio or its licensors and is protected by applicable law.
Use of the platform does not grant the user any right to reproduce, modify, distribute, sell or commercially exploit such content, unless previously and expressly authorized in writing by Servtio.
11. Changes to the Terms
Servtio may update these Terms at any time for legal, technical, or service-improvement reasons. Whenever relevant changes occur, they may be communicated through the platform and/or by email.
Continued use of the platform after the effective date of the changes constitutes acceptance of the new Terms.
12. Privacy and Data Protection
The processing of personal data is carried out in accordance with the Privacy Policy available on the platform, prepared in compliance with the General Data Protection Regulation (GDPR) and other applicable legislation.
13. Dispute Resolution
In the event of a dispute, the user may resort to Alternative Consumer Dispute Resolution mechanisms available at www.consumidor.gov.pt, without prejudice to the right to bring the matter before the judicial courts.
14. Governing Law and Jurisdiction
These Terms are governed by Portuguese law. For the resolution of disputes, the competent court shall be that of the Porto district, to the exclusion of any other, unless otherwise required by mandatory legal provisions.
